Terms and Conditions of Sale

These Terms and Conditions ("Terms") govern the sale of products by COXCOTA LIMITED (Company Number NI725210), registered in Belfast, Northern Ireland ("Seller," "we," "us," "our") to you ("Customer," "you") via the website sforne.com ("Website").

1. SCOPE, APPLICABLE LAW & CONSUMER RIGHTS

1.1. Territorial Scope and Choice of Law

• For Consumers in the European Union (EU) and United Kingdom (UK): These Terms are subordinate to the mandatory consumer protection laws of your country of residence. If you are a consumer, the law of your country of habitual residence applies, and you benefit from any mandatory provisions of that law.
• For Consumers in Switzerland: The Swiss Federal Act on Data Protection (revDSG) and the Swiss Code of Obligations apply.
• For All Other Customers (including B2B): These Terms are governed by the laws of Northern Ireland, United Kingdom.

1.2. Jurisdiction and Dispute Resolution

• EU/UK/Swiss Consumers: Any dispute shall be subject to the jurisdiction of the courts of your country of residence.
• All Others (Non-Consumers/B2B): Disputes shall be subject to the exclusive jurisdiction of the courts of Belfast, Northern Ireland.
• Online Dispute Resolution (ODR): EU consumers have the right to submit complaints via the EU ODR platform (https://ec.europa.eu/consumers/odr).

1.3. Age Restriction & Capacity

You confirm you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract. We reserve the right to request age verification before order fulfillment.

1.4. U.S. State Restrictions

We do not ship products to addresses in U.S. states where the sale of adult novelty items is expressly restricted or prohibited by state law. Currently, this includes but is not limited to: Alabama, Texas (specific counties), Mississippi, Louisiana, and Virginia (specific statutes). Orders placed from these locations will be cancelled and refunded.

2. PRODUCTS, ORDERS, AND PRICES

2.1. Product Information

We make every effort to display product colors, specifications, and descriptions as accurately as possible. However, we cannot guarantee your screen's accuracy. Product images are for illustrative purposes. Technical specifications are provided by manufacturers.

2.2. Pricing and Taxes

All prices are listed in GBP, EUR, or USD. Prices include VAT/sales tax where applicable under our Shipping & Tax policy. Delivery charges are calculated at checkout. We reserve the right to correct pricing errors at any time, including after an order is placed.

2.3. Order Formation

Placing an item in your cart does not reserve it. A legally binding contract between us is formed only when we send you an "Order Confirmation" email. We reserve the right to refuse or cancel any order at our discretion, including for: suspected fraud, inability to process payment, product unavailability, or failure to pass AML/KYC or age verification checks.

3. DELIVERY AND SHIPPING

Delivery terms, times, costs, and customer responsibilities are outlined in our separate Shipping, Delivery & Taxes policy. You are solely responsible for providing a correct and deliverable address and for any import duties, taxes, or customs clearance fees in your country. Risk of loss or damage to the goods passes to you upon delivery to the carrier.

4. RIGHT OF WITHDRAWAL, RETURNS & REFUNDS

Your right to cancel, return products, and receive a refund is detailed in our Returns, Shipping & Payments policy.

Hygiene Restriction: For health and safety reasons, intimate/sexual wellness products can only be returned if the original sealed packaging is completely unopened and intact. Once opened, these items are non-returnable unless faulty.

Your statutory warranty rights are governed by our Warranty & Statutory Rights policy and the mandatory consumer protection laws of your country of residence.

5. INTELLECTUAL PROPERTY

All content on the Website (logos, text, graphics, software) is our property or licensed to us and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission. See our Trademark & IP Disclaimer.

6. LIMITATION OF LIABILITY

6.1. Our Liability

We are liable to you for foreseeable loss and damage caused by our breach of these Terms or negligence. We are not liable for business losses (including loss of profits, revenue, contracts, anticipated savings, data, or goodwill).

Our total liability to you for any claim arising from these Terms shall not exceed the total purchase price of the order in question.

6.2. Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control ("Force Majeure"), including but not limited to: acts of God, war, terrorism, civil commotion, internet or utility failures, labor disputes, or government actions.

7. GENERAL PROVISIONS

7.1. Amendments

We may update these Terms from time to time. The version in force at the time of your order will apply. We will notify customers of material changes that affect existing rights.

7.2. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.

7.3. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and other linked policies, constitute the entire agreement between you and us regarding the sale of products.
